2022 Competition Terms and Conditions

  1. Instructions on how to enter the Performance Short Film Competition 2022 competition (“theCompetition”) and details regarding the Competition contained herein form part of these Terms and Conditions. Entry into and participation in this Competition is deemed acceptance of these Terms and Conditions. This Competition is not valid in conjunction with any other offer, competition or promotion by Performance Film & Media Insurance.
  2. No purchase is necessary to enter the Competition.
  3. The Competition is free to enter and open to any resident of the UK over the age of 18, subject to paragraph below, except employees of Performance Film & Media Insurance.
  4. Residents of the UK are entitled to enter the Competition, provided their submitted film has:
  • Been completed since 1st January 2021
  • Has a maximum running time of 30 minutes
  • Please note we can not accept any pornographic or ‘adult’ films.
  1. The Competition commences at 13:00 BST on 16th June 2022 (“the Commencement Date”) and closes at 17:00 BST on 15th August 2022(the “Closing Date”). The period between the Commencement Date and the Closing Date shall be the Competition entry period (the “Competition Entry Period”)
  2. To participate in the Competition, Entrants must submit their entry via the following webform: https://www.performance-insurance.com/form-short-film-competition-entry/. The Entrant must own the whole of the copyright in the Short Film. In circumstances where the Short Film or parts thereof are derived from or contain images, sounds or material from an existing work, the Entrants must have obtained written copyright clearance from the owner of that existing work for the use of that existing work which must be produced to Performance Film & Media Insurance on demand. In circumstances where the Short Film or parts thereof contain images of persons, locations, marks, trademarks and any other images which would require permission for their use, the Entrants must have received appropriate written releases for their use which must be produced to Performance Film & Media on demand. The Entrant shall indemnify Performance Film & Media Insurance in respect of any and all liability arising from any infringement of any rights whatsoever that may arise in respect of the Short Film and, and Performance Film & Media reserves the right to disqualify any Entrant who does not comply with the conditions set out in this clause.
  3. The Short Film must not defame any person or entity, or be disparaging to any religion, race, or nation, or contain language that is lewd, obscene or inappropriate, or use any copyrights, images, marks, trademarks or logos for which the Entrant has not obtained permission for their use. Performance Film & Media Insurance reserves the right to disqualify any Entrant who does not comply with the conditions set out in this clause.
  4. By entering the Competition, Entrants acknowledge, agree and declare that they are aware that their participation is entirely at their own risk and that they hereby waive, surrender and relinquish in favour of Performance Film & Media Insurance all claims of any nature and howsoever arising (including as a result of negligence) which but for this waiver, surrender and relinquishment they may or otherwise have against Performance Film & Media Insurance either directly or indirectly arising out of their participation in the Competition.
  5. By entering the Competition, Entrants hereby warrant that all information submitted is true, current and complete. Any Entrants who have supplied incomplete, inaccurate or fraudulent information may be automatically disqualified. Performance Film & Media Insurance reserves the right to disqualify any Entrant if Performance Film & Media Insurance has reasonable grounds to believe that an Entrant has breached any of these terms and conditions or has tampered with the Competition process. Failure by Performance Film & Media Insurance to enforce any of its rights at any stage of the Competition does not constitute a waiver of those rights.
  6. Incomplete, indecipherable or illegible entries will be deemed invalid. Entrants bear all responsibility to ensure that their entry is complete and legible, and that their Short Film is submitted in the correct format and clearly visible and audible.
  7. The costs of entering the Competition shall be borne solely by the Entrant.
  8. Upon completion of the following webform: https://performance-insurance.com/form-short-film-competition-entry/ The Entrant must indicate whether or not they grant to Performance Film & Media Insurance a nonexclusive, irrevocable license to Performance Film & Media Insurance to publish their Short Film on the Performance Film & Media Insurance website and communicate their Short Film to the public in the territory of the world, and in full or in part in any other promotional material of Performance Film & Media Insurance, for the purposes of the Competition.
  9. Following the Closing Date, the entries to the Competition shall be judged in the following distinct categories:
  • Best Comedy Short
  • Best ‘Short’ Short (less than 5 minutes in length)
  • Best Documentary Short
  • Best Horror Short
  • Best Drama

 

  1. The winner(s) of each Category shall be determined as follows:
    • A judging panel shall be appointed by Performance Film & Media Insurance in its sole discretion;
    • After the Closing Date, Performance Film & Media Insurance shall determine a shortlist of the best Short Films;
    • The judging panel shall view the Short Films on the shortlist determined by Performance Film & Media Insurance;
    • By 10th November 2022, the judging panel shall determine the winner of each category
    • The judging shall be based only on the subjective personal opinions of the judging panel and shall be final;
    • Performance Film & Media Insurance accepts no liability for the decisions made by the judging panel, and no correspondence will be entered into in this regard;
    • The Finalists will be notified via the contact details provided to the Promoter by 1st November 2022 and will be required to confirm their attendance at the live Awards Webinar. If the Finalist does not respond to such contact from the Promoter within 7 days of notification, then the Invitation will be withdrawn and the Promoter will be entitled to select another Finalist.
    • Performance Film & Media Insurance shall officially announce the winners of each category during the applicable live Awards events to beheld on 10th November 2022. Attendance of the applicable live Awards Webinar is mandatory. Failure to attend the applicable live Awards Webinar will result in full and unreserved forfeit of any Prize Package.
    • The winner shall be entitled to receive the applicable category Prize Package providing that the above terms are met.

  • £1,000 (GBP) cash prize for each winner in the 5 award categories

 

  1. Performance Film & Media Insurance reserves the right to award further Prizes or Prize Packs to winners, or to alter the content of any Prize in whole or in part at any time, whether by adding or removing Prizes. Any changes in the Prizes or the content of the Prize Package shall be notified by Performance Film & Media Insurance from time to time as the case may be.
  2. Performance Film & Media Insurance shall make reasonable efforts to deliver the Prize Packages to their respective winners at each winner’s address specified in the Competition Entry Form within six (6) weeks of the Awards Event. Performance Film & Media Insurance shall not be liable for any delays in delivery of the Prize Packages. Performance Film & Media Insurance shall not be liable for any tax payable on the value of a Prize Package.
  3. Each winner agrees to participate in reasonable post-competition publicity for Performance Film & Media Insurance at Performance Film & Media Insurance’s expense, including but not limited to their attendance for interviews, photographs, videos and any other promotional activity specified by Performance Film & Media Insurance, and grant a nonexclusive, irrevocable licence to Performance Film & Media Insurance to use their name, biographical details, photographs, videos, likenesses and any other information regarding the winner deemed appropriate for use by Performance Film & Media Insurance for any promotional and marketing purposes by Performance Film & Media Insurance for a period of one (1) year from the Closing Date.
  4. Each Entrant warrants that he or she has no other agreements or arrangements with any third parties relating to the performance, service, image, name or likeness and/or other rights that may interfere with his or her entry into the Competition and the execution of his or her obligations as the winner in this Competition.
  5. The terms and conditions of a related third-party supplier or suppliers of prizes may apply and shall be accepted by the winner or winners.
  6. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Performance Film & Media Insurance, Performance Film & Media Insurance reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate. Any cost associated with accessing the Competition website is the Entrant’s responsibility and is dependent on the Internet service provider used. Performance Film & Media Insurance makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Competition.

 

  1. Except for any liability that cannot be excluded by law, Performance Film & Media Insurance (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under Performance Film & Media Insurance’s control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Performance Film & Media Insurance) due to any reason beyond the reasonable control of Performance Film & Media Insurance; (d) any variation in the type and specifications of the prizes to that stated in these Terms and Conditions; (e) any prize that has not been received by the claimant after dispatch by Performance Film & Media Insurance; (f) any prize that has been damaged in transit; (g) any tax liability incurred by an Entrant; or (h) use of the prizes.
  2. Performance Film & Media Insurance collects personal information of the Entrants in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required by law, to regulatory authorities. Entry to the Competition is conditional on providing this personal information, and the Entrant must consent to the use of their personal information for the purposes of the Competition.
  3. These Terms and Conditions shall be governed by and construed in accordance with the laws of the UK.
  4. Performance Film & Media Insurance hereby reserves the right to change, suspend or cancel the Competition, or to change these terms and conditions, by notice on the Performance Film & Media Insurance website. Performance Film & Media Insurance shall not be required to specify any reasons for the changes and shall not incur any liability as a result.
